We introduce the notion of “δ-complete decision procedures” for solving SMT problems over the real numbers, with the aim of handling a wide range of nonlinear functions including transcendental functions and solutions of Lipschitz-continuous ODEs. Given an SMT problemϕ and a positive rational number δ, a δ-complete decision procedure determines either that ϕ is unsatisfiable, or that the “δ-weakening” of ϕ is satisfiable. Here, the δ-weakening of ϕ is a variant of ϕ that allows δ-bounded numerical perturbations on ϕ. We (...) establish the existence and complexity of δ-complete decision procedures for bounded SMT over reals with functions mentioned above. We propose to use δ-completeness as an ideal requirement for numerically-driven decision procedures. As a concrete example, we formally analyze the DPLL〈ICP〉 framework, which integrates Interval Constraint Propagation in DPLL, and establish necessary and sufficient conditions for its δ-completeness. We discuss practical applications of δ-complete decision procedures for correctness-critical applications including formal verification and theorem proving. (shrink)

Given any collection F of computable functions over the reals, we show that there exists an algorithm that, given any sentence A containing only bounded quantifiers and functions in F, and any positive rational number delta, decides either “A is true”, or “a delta-strengthening of A is false”. Moreover, if F can be computed in complexity class C, then under mild assumptions, this “delta-decision problem” for bounded Sigma k-sentences resides in Sigma k. The results stand in sharp contrast to the (...) well-known undecidability of the general first-order theories with these functions, and serve as a theoretical basis for the use of numerical methods in decision procedures for formulas over the reals. ObjectiveTo compare techniques for computing clustering and switching scores in terms of agreement, correlation, and empirical value as predictors of incident cognitive impairment.MethodsWe transcribed animal and letter F fluency recordings on 640 cases of ICI and matched controls from a national epidemiological study, amending each transcription with word timings. We then calculated clustering and switching scores, as well as scores indexing speed of responses, using techniques described in the literature. We evaluated agreement among the techniques with Cohen’s κ and calculated (...) correlations among the scores. After fitting a base model with raw scores, repetitions, and intrusions, we fit a series of Bayesian logistic regression models adding either clustering and switching scores or speed scores, comparing the models in terms of several metrics. We partitioned the ICI cases into acute and progressive cases and repeated the regression analysis for each group.ResultsFor animal fluency, we found that models with speed scores derived using the slope difference algorithm achieved the best values of the Watanabe–Akaike Information Criterion, but with good net reclassification improvement only for the progressive group. For letter fluency, different models excelled for prediction of acute and progressive cases. For acute cases, NRI was best for speed scores derived from a network model, while for progressive cases, the best model used clustering and switching scores derived from the same network model. Combining variables from the best animal and letter F models led to marginal improvements in model fit and NRI only for the all-cases and acute-cases analyses.ConclusionSpeed scores improve a base model for predicting progressive cognitive impairment from animal fluency. Virtue is the most perdurable concept in the history of ethics, which is understandable given the ineradicability of the moral agent in the events of the moral life. Historically, virtue enjoyed normative force as long as the philosophical anthropology and the metaphysics of the good that grounded virtue were viable. That grounding has eroded in both general and medical ethics. If virtue is to be restored to a normative status, its philosophical underpinnings must be reconstructed. Such reconstruction seems unlikely in (...) general ethics, where the possibility of agreement on the good for humans is remote. However, it is a realistic possibility in the professional ethics of the health professions where agreement on the telos of the healing relationship is more likely to arise. Nevertheless, virtue-based ethics must be related conceptually and normatively to other ethical theories in a comprehensive moral philosophy of the health professions. (shrink)

On June 11, 1963, in a dramatic gesture that caught the nation's attention, Governor George Wallace physically blocked the entrance to Foster Auditorium on the University of Alabama's campus. His intent was to defy Attorney General Nicholas Katzenbach, sent on behalf of the Kennedy administration to force Alabama to accept court-ordered desegregation. After a tense confrontation, President Kennedy federalized the Alabama National Guard and Wallace backed down, allowing Vivian Malone and James Hood to become the first African Americans (...) to enroll successfully at their state's flagship university. That night, John F. Kennedy went on television to declare civil rights a "moral issue" and to commit his administration to this cause. That same night, Medgar Evers was shot dead. In The Schoolhouse Door, E. Culpepper Clark provides a riveting account of the events that led to Wallace's historic stand, tracing a tangle of intrigue and resistance that stretched from the 1940s, when the university rejected black applicants outright, to the post-Brown v. Board of Education era. We are there in July 1955 when Thurgood Marshall and lawyers at the NAACP Legal Defense Fund win for Autherine Lucy and "all similarly situated" the right to enroll at the university. We are in the car with Lucy in February 1956 as university officials escort her to class, shielding her from a mob jeering "Lynch the nigger," "Keep 'Bama white," and "hit the nigger whore." Clark exposes the many means, including threats and intimidation, used by university and state officials to discourage black applicants following the Lucy episode. And he explains how University of Alabama president Frank Anthony Rose eventually cooperated with the Kennedy administration to ensure a smooth transition toward desegregation. We also witness Robert Kennedy's remarkable face-to-face plea for Wallace's cooperation and the governor's adamant refusal: "I will never submit voluntarily to any integration in a school system in Alabama." As Clark writes, Wallace's carefully orchestrated surrender would leave the forces of white supremacy free to fight another day. And the Kennedys' public embrace of the civil rights movement would set in motion a political transformation that changed the presidential base of the Democratic party for the next thirty years. In these pages, full of courageous black applicants, fist-shaking demonstrators, and powerful politicians, Clark captures the dramatic confrontations that transformed the University of Alabama into a proving ground for the civil rights movement and gave the nation unforgettable symbols for its struggle to achieve racial justice. Pellegrino (bio)AbstractBioethics was officially baptized in 1972, but its birth took place a decade or so before that date. Since its birth, what is known today as bioethics has undergone a complex conceptual metamorphosis. This essay loosely divides that metamorphosis into three stages: an educational, an ethical, and a global stage. In the educational era, bioethics focused on a (...) perceived “dehumanization” of medicine by the rising power of science and technology. Remedies were sought by introducing humanities, ethics, and human “values” into the medical curriculum. Ethics was one among the humanistic disciplines, but not the dominant one. In the second era, ethics assumed a dominant role as ever more complex dilemmas emerged from the rapid pace of biological research. As such dilemmas were applied to medical practice, the need for a more rigorous and more formal analysis of their moral status was clear. Philosophically-trained ethicists had an obvious role. They began to teach, write, and profoundly influence medical education and practice. In the third—and present—period, the breadth of problems has become so broad that ethicists must, themselves, draw on disciplines well beyond their expertise—e.g., law, religion, anthropology, economics, political science, psychology, and the like. The era of bioethics as a global enterprise is upon us. The original hope for humanizing medicine has not been overtly successful; however, much has been accomplished of value to patients, the profession, and society. Medical morality has been transformed into a formal, systematic study of a whole range of issues of the greatest significance to humanity. Now the major challenge is one of identity, or inter-relationships and connections between the theoretical and the practical. Bioethics has outgrown its beginnings.I have been invited to give a “personal recollection” of the early development of bioethics. Such invitations are notoriously hard to resist, but also problematic when they are the recollections of a participant [End Page 73] in the events to be described. We need only be reminded of the vagaries common to the plethora of memoirs on the book stands today. Few have escaped the perils of selective memory, self-promotion, or the settling of old scores. Yet their perils notwithstanding, memoirs may serve some useful purpose. They are the raw material—verbal kitchen middens so to speak—out of which historians can later sift fact from fancy. They enable “tribal elders” to give witness to the past from which the present can fashion some sense of continuity.I will organize my reflections around three very arbitrary time periods that represent my own way of thinking about the evolution of bioethics: (1) an era of “proto-bioethics” (1960–1972), (2) an era of philosophical bioethics (1972–1985), and (3) an era of global bioethics (1985-present). Each era, of course, overlaps with the others, and the dominant strand of each runs through the others as well.In the proto-bioethics period, the language of human values predominated; in the era of bioethics philosophically construed, it was the language of philosophical ethics; and in the era of bioethics globally construed, the social and behavioral sciences have gained greater prominence. In each period, interest in the traditional humanities other than philosophy waxed and waned. In the earlier years, religion and theology predominated. Daniel Davis (bio)Approximately two weeks before what was to have been its final meeting, the White House dissolved the President’s Council on Bioethics by terminating the appointments of its 18 members. The letters of dismissal, dated 10 June 2009, informed the members that their service on the Council would end with the close of business the next day.The Council’s term (...) was set to expire on 30 September 2009. After President Obama’s election in November and during the transition, we were advised to proceed on the assumption that the Council would be permitted to cease on that date. Reasons for the abrupt move to disband the Council are unknown. We have accepted the fact that we Council members served at the pleasure of the President and that he simply exercised his rightful prerogative. No explanation is therefore required.Some observers have speculated that the action was retaliatory. They related to the fact that several members of the Council disagreed with the President’s stem cell policy in a signed statement published in the Hastings Center’s Bioethics Forum. Others have speculated that the move was pre-emptive. At its final meeting, scheduled for 25–26 June, the Council was set to sign-off on two of its final publications. One was a comprehensive report on the ethics of organ transplantation, and the other a white paper entitled Health Care and the Common Good. The aim was immediately to release the latter as a contribution to the intensifying debate about health care reform. Health Care and the Common Good could well have aided rather than impeded the President’s drive to better control health care costs and achieve universal coverage. The Council report attempted to ground both goals in the ethical framework of, as the title indicates, the common good of all Americans.In his letter terminating the members’ appointments, Assistant to the President for Presidential Personnel Don Gips said that the President “recognizes the values of having a commission of experts in bioethical issues to provide objective and non-ideological bioethics advice to his administration.” Gips went on to say that the President is “currently rethinking the purposes and goals of such a bioethics commission, and is carefully considering a revitalized mission and mandate.” And, [End Page 309] responding to media enquiries, White House press officer Reid Cherlin explained that the President’s Council was terminated because it was a “philosophically leaning advisory group” and, according to a New York Times account by Nicholas Wade, “because it favored discussion over developing a shared consensus.” As for the ultimate outcome of the President’s “rethinking,” Cherlin indicated that President Obama will appoint a new commission with the mandate of offering “practical policy options” in bioethics.In the light of our experiences with the Council, we leave it with hopes that certain questions of national importance will be addressed. In light of the nature of federal advisory commissions, what is or are the proper roles of a national bioethics commission? If the aim is to provide advice and counsel to the President or, perhaps to the U. S. Congress, is that advice best rendered as a group consensus or as an in-depth exploration of the inevitably conflicting ethical perspectives on a given issue? How should such a commission be constituted—with what sorts of individuals? And what is the nature of the expertise that they individually and collectively bring to the commission’s functions? If the commission is to promote public debate and discussion, how exactly should it go about that task? And how is the efficacy of a commission to be assessed? Pellegrino (bio)When André Hellegers founded the Kennedy Institute, he envisioned a close collaboration between ethics and clinical practice. He even called for physician specialists whose expertise would be in both fields (Reich 1994, p. 324). A quarter of a century later, his vision and prediction have become realities. Clinical ethics is today a thriving entity with its own literature, practitioners, and (...) methodology.This clinical turn has, on the whole, been salutary. The abstractness of ethical theory has been tempered by the concreteness of clinical realities; clinicians have been helped to make bedside decisions even in the face of theoretical uncertainty and dissonance; and a variety of disciplines besides theology and philosophy have entered ethical discourse and enriched it.These advantages notwithstanding, clinical ethics has certain inherent traits that make it problematical. Some seek its norms in what “works” in practice or in paradigm cases (Jonsen and Toulmin 1988); others shape it to achieve consensus or satisfy the needs of public policy (Meilaender 1995); still others reduce bioethics to merely a method for the resolution of moral conflict. Rather than simply modulating theory by practice, clinical ethics can end up by repudiating theory entirely (Toulmin, in press). Taken to their logical conclusion, these tendencies make clinical ethics a species of the antifoundationalism that has strongly influenced moral philosophy in the last decade (Tollefsen 1995, pp. 3–18; Rockmore and Singer 1992). But antifoundationalism itself is a theory of ethics even though it supposedly denies the validity of any overarching theories.Antifoundationalism presents its own difficulties. For one thing it begs important questions that will not go away: for example, how do we know that a decision is a good one? what does it mean to say that a decision “works”? is the [End Page 347] outcome of a good decisional procedure itself a good decision? and to what extent are compromise and exigency admissible in moral decisions? Theoretical and “foundational” questions of this sort will not evaporate because they are ignored. They inevitably will be answered by begging the essential questions or grounding them solely in prelogical presuppositions.To avoid these difficulties, the advantages of clinical ethics must be retained without capitulation to the anti-theory bias of contemporary philosophy. This means that theory and practice must both be retained and be conceptually related to each other. To effect this we must take account of the long intellectual history of the relationship between the speculative and the practical intellect—i.e., between knowledge sought for its own sake and knowledge sought for some use beyond simply the possession of it (Lobkowicz 1967, pp. 78–81). Suffice it to say that medicine has long been the paradigm case for the union of theory and praxis. Relating them conceptually is an essential propaedeutic to any theory of moral praxis in medicine.The rest of this essay examines the inextricability of theory and practice in two of the three major branches of clinical ethics—the substantive and the professional. The third branch, procedural ethics—i.e., the ethics of the process of decision making—deals with informed consent, with respect for persons, professional colleagues, and families, and with the ethics of conflict resolution. Obviously, there are theoretical issues here as well. This dissertation examines Sigmund Freud's psychoanalysis with particular regard to the problem of nihilism, and the philosophy of history that Edmund Husserl and Georg Lukacs argue is needed in its wake to restore reason's capacity to give order and direction to human life. I understand nihilism not merely as the theory that life is devoid of value, but rather as an historical crisis in the sense of autonomy that results from the separation of fact and value in the thoroughly (...) rationalized modern world. How, I ask, does Freud respond to this crisis? And how does his response stand in relationship to those offered by philosophers? Does psychoanalysis too provide a philosophy of history? ;To answer these questions, I first examine the development of psychoanalysis in response to the suffering of neurotics as a crisis in the authority of science to address human needs. I then explicate the problem of nihilism as it is registered by both Husserl and Lukacs, examine the philosophies of history that they each construct in response to it, and consider Freud's theory of civilization in relationship to them. ;By constructing philosophical methodologies to defend reason's teleology, I argue that both Husserl and Lukacs implicitly disavow the problem that they purport to address by presupposing the autonomy of reason, and treating the problem of nihilism as the result merely of a misconception concerning its place and function in the world. As late as 1923 Freud too presupposes reason's autonomy from the terror expressed in religion. However, with his subsequent recognition of the problem presented by the unconscious sense of guilt, Freud no longer treats the rational overcoming of illusion as an intrinsic good. He sees civilization too as radically ambivalent and revises his social theory as a critique of the discontent that immanently plagues it. Rather than a philosophy of history, I argue that Freud constructs a critique of the problem presented by the persistent demand for teleological orientation in a post-historical world. (shrink)

A first section defends my method. The main body of the paper then defines and rejects voluntarist, stoic, and developmental hedonist lessons to be taken from central crises in my two subjects' autobiographies, and argues for (...) a fourth, diagnostic lesson: Gosse and Mill perceive their individual good through the medium of pleasure. Finally, I offer some speculative moral psychology of human development, as involving the waking, perception, management, and flowering of generic and individual capacities, which I suggest underlies Gosse and Mill's experiences. The acceptance of one's own unchosen nature, discovered by self-perceptive pleasure in the operation of one's nascent capacities, is the beginning of a flourishing adulthood in which that nature is fully developed and expressed. Its status involves the questioner at once in a series of peculiar problems. The question "What is chemistry?" (for instance) would surely seem to admit of an answer. Even if there were a dispute about the wording of a definition, the general region to which the (...) question directs us seems relatively secure. "What is chemistry?" asks about the essence of a physical science and, as a consequence, the questioner will be situated in the realm of the philosophy of science. "What is philosophy?" however, can make no such leap. A "philosophy of philosophy " is simply tantamount to more philosophy. The question of philosophy 's essence can only be posed within philosophy. Moreover, would not this very question of an essence ofphilosophy be determined in advance by an understanding of "essence" by philosophy, which thus seems remorselessly to encompass the borders of that which might try to enclose it? The mode of questioning on the (impossible?) borders of philosophical discourse is the site of Martin Heidegger's so-called overcoming of Western Metaphysics. More recently, Jacques Derrida has intensified the mode of borderline questioning, engaging himself in both a radicalization and displacement of Heideggerian questions. Derrida writes, in "Violence and Metaphysics" (1964), "The entirety of philosophy is conceived on the basis of its Greek source. As is well known, this amounts neither to an occidentalism, nor a historicism. It is simply that the founding concepts of philosophy are primarily Greek, and it would not be possible to philosophize, or to speak philosophically, outside this medium."1 Derrida continues to discuss Husserlian phenomenology and the thought of Heidegger in terms of their insistence on 75 76Philosophy and Literature conceiving philosophy according to its Greek impetus. If something is to transpire in the traditions of philosophy, its origin "will have to be summoned forth and adhered to as rigorously as possible" (p. 81). The specific "event" to be attended to will be what Derrida, after Heidegger, describes as the determination ofbeing as presence. This, it is argued, is constitutive in respect of philosophy and all the regional disciplines it governs. Needless to say "the determination of being as presence" demands considerable explication. The Greek nature of philosophy is discussed by Heidegger in the lecture, "What is Philosophy?"2 The question raises the problem of philosophy 's relation to its limits. Tb ask the question "What is Philosophy?" is not to step outside thought to some "metaphilosophical" realm. It is to be already standing in Greece. What is specifically Greek and decisive, in fact, is the very mode of the question ''What is XT' itself: "But not only what is in question —philosophy— is Greek in origin, but how we question, the manner in which we question even today, is Greek. We ask, "what is that—" (p. 35). The Greek mode of questioning something as to its whatness {ti estin?, "what is it?") has now become thoroughly familiar. Its novelty and Greek source have become obscured: "It is this form of questioning which Socrates, Plato, and Aristode developed. They ask, for example, What is the beautiful? What is knowledge?'..." (p. 37). Heidegger's characterization of the question, ti estin?, as decisively Greek must be distinguished from Edmund Husserl's apparently similar description of the fundamentally Greek nature of philosophy. Husserl characterized the theoretical relation to the world as a legacy which has largely determined Western Europe and, indeed, the modern world itself, a determination most palpable in the proliferation of the various sciences. The theoretical attitude is one of pure curiosity towards entities : "man becomes the disinterested spectator, overseer of the world, he becomes a philosopher."3 Moreover, the devotion to pure theoria builds up a body of disinterested knowledge in which others may participate and to which they may add. A universal culture, a project traversing individual and national difference, comes into being. The Greek philosopher embodied, for the first time, a type ofhumanity and culture to which the European world still belongs. Despite an ever-growing scholarly interest in the work of Edmund Husserl and in the history of the phenomenological movement, much of the contemporaneous scholarly context surrounding Husserl's work remains shrouded in darkness. While much has been written about the critiques of Husserl's work associated with Heidegger, Levinas, and Sartre, comparatively little is known of the debates that Husserl was directly involved in. The present volume addresses this gap in scholarship by presenting a comprehensive selection of contemporaneous responses to Husserl's (...) work. Ranging in date from 1906 to 1917, these texts bookend Husserl's landmark Ideas for a Pure Phenomenology and Phenomenological Philosophy. The selection encompasses essays that Husserl responded to directly in the Ideas I, as well as a number of the critical and sympathetic essays that appeared in the wake of its publication. Significantly, the present volume also includes Husserl's subsequent responses to his critics. All of the texts included have been translated into English for the first time, introducing the reader to a wide range of long-neglected material that is highly relevant to contemporary debates regarding the meaning and possibility of phenomenology. This essay examines the debate that arose immediately following the publication of the first volume of Edmund Husserl's Ideas regarding the model of concept formation that Husserl sketches in that work. After a brief overview of the relevant passages from the Ideas, I take up essay-length responses to Husserl by August Messer, Theodor Elsenhans, and Heinrich Gustav Steinmann. Reflecting a variety of empiricist commitments, all three authors are skeptical that concepts can be expected to embody the essence of a (...) corresponding phenomenon. Subsequently, I review the responses to these critiques offered by Husserl, his then-assistant Edith Stein, and Paul Linke. For Linke, it is at least highly probable that certain concepts derive their content from an apprehension of essence. The empiricist alternative, he argues, is fatally unstable. Husserl and Stein, meanwhile, offer a more forceful defense of this position. Unless we allow that certain kinds of concepts can originate from a grasp of essence, they argue, we will be unable to explain how certain manifest cognitive accomplishments are possible. (shrink)

In the 1950s and 60s, before there was a Kennedy Institute of Ethics or a Hastings Center; before the word ‘bioethics’ itself was coined, Pellegrino was writing articles such as "Ethical Considerations in the Practice of Medicine and Nursing," published in 1964. He was among those who started the Society for Health and Human Values—a precursor organization to the American Society for Bioethics and Humanities. The words quoted above distill the common secular conception of death. If we decline the traditional religious reassurances of an afterlife, or their fuzzy new age equivalents, and instead take the hard-boiled and thoroughly modern materialist view of death, then we likely end up with Gonzalez-Cruzzi. Rejecting visions of reunions with loved ones or of crossing over into the light, we anticipate the opposite: darkness, silence, an engulfing emptiness. But we would be wrong.
